This procedure concerns the processing by the operator of personal data resulting from the records of the CCTV surveillance system located at the entrance of the operator\u2019s office, located in Cluj-Napoca, Plopilor St, no. 68, ground floor, Cluj County.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2df68d4 elementor-widget elementor-widget-heading\" data-id=\"2df68d4\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Categories of personal data subject to processing<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c098626 elementor-widget elementor-widget-text-editor\" data-id=\"c098626\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li>the appearance of employees and third parties entering the operator\u2019s office and server room;<\/li><li>the entries of employees and third parties at the processor\u2019s office;<\/li><li>the activity of employees involved every year in projects, exclusively for the duration of projects development.<\/li><li>Video recordings that capture the image of individuals entering the workplace are not biometric data,\u00a0considering:<ul><li>the paragraph 51 in GDPR recitals<\/li><li>the video recordings are specifically a series of photographs that capture the movements of people in chronological order and<\/li><li>the video recording means that we use do not allow the unique identification of persons or the authentication of natural persons, by not having a facial identification software.<\/li><\/ul><\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-395963a elementor-widget elementor-widget-heading\" data-id=\"395963a\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">The purpose of the procedure<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ed89142 elementor-widget elementor-widget-text-editor\" data-id=\"ed89142\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The purpose of this procedure sets out how the personal data mentioned in Chapter I are processed by the processor, namely ensuring the security of assets and persons, at its office located in Cluj-Napoca, Plopilor St, no. 68, ground floor, Cluj county.<\/p><p>The processing is also necessary to fulfill the legal obligation provided in art. 50 paragraph 1 letter e)\u00a0of Law 333\/2003.<\/p><p>The operator is among the units provided in art. 2 paragraph 1 of Law 333\/2003, being a\u00a0trading\u00a0company regulated by Law 31\/1990, and the CCTV surveillance camera represents an alarm system against\u00a0burglary, according to the definition provided in art. 27 paragraph 5 of the same normative act.<\/p><p>Besides,\u00a0obtaining\u00a0\/\u00a0keeping\u00a0up to date\u00a0the ISO 27001 certification, requires the installation of a video surveillance system at the entrance\u00a0in order to\u00a0protect the company\u2019s assets.<\/p><p>As regards\u00a0the\u00a0activity data\u00a0of the employees involved\u00a0yearly\u00a0in the projects, the purpose of their processing is to ensure an efficient communication between the client of the operator who organizes the events and the operator.\u00a0More specifically, the camera installed in the office does not store and \/ or archive the\u00a0images but\u00a0ensures a\u00a0live\u00a0streaming\u00a0with the client strictly during the events.\u00a0Live\u00a0streaming\u00a0to the customer is necessary so that\u00a0it\u00a0can identify the operator\u2019s employees involved in the events that are available, if any problems arise or if the customer urgently needs to communicate something about the\u00a0development\u00a0of events.<\/p><p>The data processed by the operator resulting from the records of the CCTV surveillance system will never be used for the purpose of monitoring the activity of employees.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8d7398b elementor-widget elementor-widget-heading\" data-id=\"8d7398b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">The basis for the processing of personal data\n<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-06cad2c elementor-widget elementor-widget-text-editor\" data-id=\"06cad2c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The personal data resulting from the recordings of the CCTV surveillance system are processed pursuant to art. 6 letter c of the GDPR:\u00a0The processing is necessary for the fulfillment of a legal obligation\u00a0of\u00a0the operator.<\/p><p>With regard to\u00a0data on the activity of employees involved\u00a0yearly\u00a0in projects,\u00a0the basis of the processing is art.6 letter f of the GDPR:\u00a0the processing is necessary for the purpose of the legitimate interests pursued by the operator or by a third party.<\/p><p>Regarding the latter data, the provisions of art. 5 of Law 190\/2018\u00a0are applicable,\u00a0thus\u00a0the conditions for processing\u00a0are\u00a0being met.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8090961 elementor-widget elementor-widget-heading\" data-id=\"8090961\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Categories of persons to whom personal data processed by the operator will be disclosed\/divulged\n<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-30cb176 elementor-widget elementor-widget-text-editor\" data-id=\"30cb176\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>a. Operator\u2019s employees,\u00a0who have signed a confidentiality agreement with the\u00a0processor\u00a0regarding the personal data\u00a0submitted to\u00a0processing.<\/p><p>Sys Admin is the one to have access to personal data captured by the CCTV surveillance system, only on demand, in case of security incidents that require the consultation of video recordings.<\/p><p>b. Public institutions and authorities,\u00a0to the extent\u00a0that the operator has a legal obligation\u00a0to disclose personal data to them or\u00a0in so far as\u00a0the data divulgement\u00a0necessary for the exercise of the operator\u2019s rights arising from a security incident (eg.\u00a0disclosure of data to the Public\u00a0Ministry, following the\u00a0formulating by\u00a0the operator of a criminal complaint under the aspect of committing the crime of theft, because the video camera captured the image of the offender).<\/p><p>c. Data on the employees\u2019 activity involved annually in projects\u00a0will be disclosed\u00a0by default\u00a0to the\u00a0Client who organizes the events.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b90ae41 elementor-widget elementor-widget-heading\" data-id=\"b90ae41\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Expected deadlines for the deletion of data under processing\n<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ca5dea8 elementor-widget elementor-widget-text-editor\" data-id=\"ca5dea8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Personal data captured by video recordings will be deleted after a\u00a030-day period\u00a0from the recording.<\/p><p>In the event of a security incident\u00a0at\u00a0operator\u2019s work point,\u00a0the data necessary to investigate this incident and only those that are useful for identifying the\u00a0offender\u00a0(s) will be\u00a0stored\u00a0for as long as the criminal or civil liability of the\u00a0offender\u00a0(where appropriate,\u00a0the limitation period\u00a0of criminal or civil liability).<\/p><p>Data on the activity of employees involved in projects are not\u00a0subject to storing.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f0be690 elementor-widget elementor-widget-heading\" data-id=\"f0be690\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Technical and organizational measures for the security of personal data\n<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f3f6239 elementor-widget elementor-widget-text-editor\" data-id=\"f3f6239\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul><li>Personal data resulting from CCTV surveillance system records will only be accessed in case of a security incident at the workplace<\/li><li>On the assumption of a security incident, the data will be accessed as long as the investigation extent only by SysAdmin on request. SysAdmin is an employee or a person in charge of the operator bound by the obligation of confidentiality with regard to the data processed<\/li><li>The operator collects just personal data that are necessary for the purposes of processing set out in Chapter II and lays down time-limits for retaining these data, unless a security incident occurs and the data are necessary for criminal or civil liability of the offender (s)<\/li><li>Security measures of the space in which personal data are stored \u2013 personal data are stored in a space that is not accessible to third parties and which is equipped with an alarm and security system<\/li><li>The CCTV surveillance system purchased by the operator is among the most secure on the market and is able to provide protection against unauthorized access by third parties.<\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b2f1af6 elementor-widget elementor-widget-heading\" data-id=\"b2f1af6\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">The rights of data subjects<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c6ced70 elementor-widget elementor-widget-text-editor\" data-id=\"c6ced70\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol><li>The right to be\u00a0informed;<\/li><li>The right of access, rectification, erasure,\u00a0restrict processing, object to\u00a0processing;<\/li><li>The right to lodge a complaint with the\u00a0National\u00a0Supervisory Authority\u00a0for Personal Data Processing<\/li><li>The right to be informed about the breach of personal data security<\/li><\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e433d72 elementor-widget elementor-widget-heading\" data-id=\"e433d72\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Correlative obligations of the operator<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fcad9fb elementor-widget elementor-widget-text-editor\" data-id=\"fcad9fb\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The operator\u00a0hereby\u00a0provides\u00a0the data subject with information on the actions taken following a request\u00a0for\u00a0the data subject\u2019s rights, without undue delay and in any case within one month of receipt of the request.\u00a0Data subject\u00a0has the possibility\u00a0to lodge a complaint\u00a0against\u00a0the\u00a0operator,\u00a0with the\u00a0Supervisory\u00a0Authority and to\u00a0make a judicial appeal, if it takes no further action.<\/p><p>The operator shall inform the data subject of any such extension, within one month of the request, stating the reasons for the delay.<\/p><p>The operator will keep a record of the processing activities carried out under his responsibility.\u00a0The records are\u00a0put forward\u00a0both in writing and electronic format.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>GDPR for TEC Software Solutions S.R.L. &#8211;
